Image purchase understanding:
I understand that any image used for presentation by BICO is a suggestion only. I agree to not use any layout presented by BICO for any purpose whatsoever. I also agree not to use any images BICO may present as suggestions. I will only use images that I have rightfully purchased and within their stipulated usage period and indemnify BICO from any liability caused due to lapse on my company's behalf in this regard.
ASCI mandate
I hereby state that any claim made in the brief to BICO falls within the advertising standards prescribed by the Advertising Standards Council of India (ASCI). I hereby indemnify BICO from any liability caused due to lapse on my company's behalf in this regard.
Information veracity and indemnity to the agency 1. I hereby declare that the information given in support of the brief, including any information update(s) to BICO, is accurate, complete, and up-to-date, and understand that any misrepresentation will result in rejection of my request for creative development and subsequent cancellation of my brief. I understand and agree that no refund will be due in case of such violation
2. I understand that original certificates in support of the claims listed in the brief, including any information update(s) to BICO, will be required for verification upon request by BICO before handing over final files. Failure to produce these for verification WILL result in rejection of my request for creative development and subsequent cancellation of my brief.
3. I authorize BICO to use my data for all types of processing relevant to my request relevant or related purposes, including research
4. I authorize BICO to independently verify my claims and obtain all records from any sources pertaining to this
in India or elsewhere.
5. I understand that, upon my registration, the data will become a part of a record and may be used for all purposes by BICO
6. I agree that I cannot use any material supplied by BICO unless I have paid all dues.
7. I understand and agree that my filling the brief format does not put any legal, moral or ethical compulsion on BICO to respond to it. I understand and agree that BICO has the full right to not take up the task for any reason it may find appropriate
8. I understand and agree that by filling this brief, I have no legal rights, claims or obligations placed on BICO for delivering any creative or work to me
9. I understand and agree that the this brief framework is the copyright of BICO and I will not reproduce,copy or modify it for my own or my company's use
10. I indemnify BICO from any liability due to incorrect information provided by me in this brief
11. I agree to pay all vendors immediately and in full amount as mentioned in their correspondence to us, from whom BICO enters into purchase agreement on my behalf and for developing creative work requested for by me and the organization I represent at the time of sending the brief, irrespective of any dispute arising on the output there after.
12. I understand and agree to pay 13% interest per month for any delay in payment once I have initiated the job by sending the brief
13. I state under oath that the work requested for is for commercial purpose to help in the marketing of goods and services within the law of the Republic of India.
14. I further state that the product/service falls under the stipulations of the Government of India
15. I state that this product/service is not illegal neither will it cause any harm directly or indirectly to any individual, institution, organization, group of people or religion. I state that full responsibility in this regard lies with me and I indemnify BICO in the event of any oversight on our part in this regard
16. No output produced by BICO will be used for any malicious intent against any country, group of people or religious belief. I state that full responsibility in this regard lies with me and I indemnify BICO in the event of any oversight on our part in this regard
17. I understand and agree that BICO is only creating output based on the brief and input provided by me and I take complete and sole responsibility for any miscommunication that may emerge as a outcome. I absolve BICO completely from any adverse or negative impact and I indemnify BICO in the event of any oversight on our part in this regard
Usage Details
I understand and agree that usage of this creative is restricted to one year only and any extended use will be charged accordingly
I understand and agree that I cannot modify this creative into a different shape or design. Any such change will be charged additionally by BICO
Rights limitation
All images, photos and videos developed by BICO for me are under license agreements that I agree to honor. I will abide by those terms and understand and agree to pay damages if I am found to have contravened the agreement in letter or spirit. I declare that I shall be solely responsible for such actions and indemnify BICO from any claims and damages that may emerge as a result of my actions.
Terms and conditions 1. GST will be additional as per government stipulation at the time of raising final bill
2. Cost of pictures/images and image touch up costs will be additional.
3. Any travel costs borne on behalf of client will be extra
4. Any additional work will be estimated and charged separately
6. All production and third party costs such as software development, email blast, web development etc will be additional.
7. Project details, logos, sizes, specifications, mandatory lines, renders etc to be provided by client
8. Language translations will be extra
9. All designs will include a single artwork. Multiple artworks will be extra
10. Copyrights for usage within the Indian market, of all material originally created by us on your behalf including logo designs, material for ads and other creative executions is for a period of one-year only
11. Any field left blank or incorrectly filled will render the brief invalid. No refund will be paid in such a case
